The Necessities of Laws Governing the Provision of Citizens' Right to Protest; With a Look at the Iran's Legal System

Abstract

The right to protest is recognized as a civil right in legal systems and its scope is expanding. Governments usually consider the exercise of this right a threat to their policies and actions, and they take steps to restrict this right to avoid potential challenges arising from popular protests. In the meantime, the legislative branch, as a representative of the nation, is obliged to protect the legitimate rights and freedoms of citizens by passing appropriate laws. Legislation in the field of rights and freedoms is a sensitive matter and requires considering very precise components. The present study seeks to find a detailed answer to the question of what necessities should be observed in drafting a comprehensive law in Iran's legal system, given the shortcomings of existing laws to ensure the right to peaceful protest for citizens. This article, organized with a descriptive-analytical research method, categorizes the most important necessities of relevant laws into three groups and concludes that Iran's legislative system, in order to dynamism and update itself to ensure the maximum right to protest for citizens, should first address shortcomings such as lack of transparency, conflict, and undue silence, and in the next step, approve a comprehensive law in this area - observing the necessary standards - so that the major rules guaranteeing the right to protest are clarified in a unified legal text.
